May 3, 2022 – USCIS has issued statement that Department of Homeland Security is temporarily amending existing regulations providing for the automatic extension of certain Employment Authorization Documents (EADs).
Certain renewal applicants who have filed Form I-765, Application for Employment Authorization, qualify for an automatic extension of their expiring employment authorization and/or EADs while their application is pending.
Per USCIS Individuals qualify for this extension if:
Properly filed Form I-765 for a renewal of your employment authorization and/or EAD before your current EAD expired, and
Are otherwise eligible for a renewal, which means that: Your renewal application is under a category that is eligible for an automatic extension
A complete list of EAD categories eligible for automatic extensions, together with applicable conditions for such automatic extensions, can be found on the USCIS website.
Note: Does not apply to EAD categories eligible for automatic extensions.
Spouses of H, L, and E visa holders continue to qualify for the automatic extension of up to 540 days only if the applicant filed a timely renewal application and has a Form I-94 in the applicable status that is valid beyond the EAD expiration date.
Applicants in dependent H, L, and E categories are only eligible for an automatic extension period of up to 540 days or their Form I-94 expiration date, whichever is earlier.
